The Elements of the Crime

In matters holocaustic the merits of any individual claim can be debated forever -- and they usually are. But in criminal matters there are certain requirements necessary to even get the police to open an investigation. As the assertion of gas chambers for mass extermination is the assertion of a crime, as a minimum it must satisfy at least one of the criteria the police would have for to open an investigation.

These are the irreducible and fundamental elements of a crime. I am certain they can be stated much better in law texts and that these would be worth no more than a C on a law exam but also they would be considered correct.

At least one of the three is just for an investigation. It would take more than one to obtain a conviction. And of course if you have A, C is evident. C stands alone in cases where a person disappears and there are other reasons to suspect a crime.

A. A body
Not simply a body for course but one which a forensic pathologist will certify as to the cause of death being unnatural. In the case of gas chambers there must be autopsies of bodies showing the cause of death as having been gas and the bodies identifiable as likely Jewish.

B. A suitable murder weapon with evidence of use
In a common murder case this would be insufficient in itself without finding human remains associated with it. Simply finding a fired gun does not mean anyone was killed. Finding a car with the impression of a skull in the grill would be investigated further.

C. A missing person
In the matter of the missing six million, it must be established they are missing from the earth not just from a few countries of Europe. To do this it is necessary to have pre and post war world wide census figures from which any person can do the arithmetic and determine there are six million fewer after the war.

Not one of the three are present in the claims of holocaustic gas chamber exterminations. There exists not one pathology report showing death by cyanide poisoning or any other gas. There does not exist any building, standing or ruined, which has any of the engineering features necessary for handling large quantities of cyanide gas. And the strangest thing of all, no evidence of any significant number of missing people.

The lack of evidence of missing people is illuminating. The number six millions was established in October 1945, long before any post-war European census was conducted much less time for nations around the world to take censuses. So there was no actuarial basis for the number at the time it was adopted. Absent supporting data for the number there is no other conclusion but that it was invented, that it is an arbitrary and capricious number.

Additionally many countries which would have been likely destinations for fleeing Europeans do not collect census data by religion, the US among them. So there could never have been any adequate basis for establishing any significant number of the missing. But we are faced with the fact that a number pulled out of the air in October 1945 has forever after been the unchallenged, official number.

Eyewitness stories rejected
A fact of life is that eyewitnesses are the least reliable source. A fact of law is that eyewitnesses can only testify to the evidence. A story is not under oath so it is not testimony nor is a story evidence. The reality is, if stories were evidence there is more evidence of greater quality for alien abductions than for gas chambers.

Confessions rejected
If we have learned anything over the centuries, with witch trials as prime examples, confessions are very easy to obtain. In this case, even if voluntary, they do not differ from eyewitness stories because they must also be in support of A, B or C above. They cannot stand alone. Another fact of human nature is, the more heinous the crime the more people will confess to it.

A handful of documents, rejected
There were tens of millions of documents captured after WWII. There are less than ten documents which appear incriminating. They only appear incriminating if one assumes a sinister meaning to common terms. Those which appear explicit report things which no one claims happened. They do not report things which people claim happened.

Begging the question, rejected
And finally, why would they lie? I have no idea why anyone lies. I do know that lying is very common human behavior. I know of examples where people have lied about themselves and even their real identity to wives and family for decades until exposed. Why would they lie is the same as asking why people lie and I admit I do not know.

Read the above carefully. There is nothing which needs be explained.

The world has had since 1945 to establish any of the elements to make it worthy of investigation. It is impossible to excuse this absence. It is impossible to accept a story which was never established in the first place.
